EC might withdraw Third Energy Package case against Romania at CJEU (official)
The European Commission might withdraw its case against Romania at the Court of Justice of the European Union (CJEU) if the country fully implements the norms of the Third Energy Package, the Government Agent for this Court Razvan Horatiu Radu alleges. 'There are two infringement procedures against Romania brought before the CJEU for failing to implement two directives in the electricity and natural gas sector; namely, this is the Third [legislative] Energy Package [for an internal EU gas and electricity market]. Assisted by the Romanian Energy Regulatory Authority (ANRE) and the Energy Department [of the Ministry of Economy], we have already formulated our defence. From our point of view, these actions do stand a chance. A case opened at CJEU against us does not automatically mean we are found guilty. Talks with the European Commission are in progress. (...) To the extent that Romania adequately implements the two Directives according to EU requirements, there is ground for the European Commission to withdraw its case against Romania,' Radu said on Wednesday in Bucharest, at a meeting of the EU Working Party on Litigation.
He stressed that Romania was 'never found guilty' so far by the Court of Justice of the EU.
As regards the priorities for 2014, Razvan Horatiu Radu added that Romania intends to continue a constructive dialogue with the EU on the infringement procedure, or on the classification of actions as preliminary infringement procedures.
In 2013, the Government Agent for the CJEU worked on 74 cases of infringement procedures.
